3.1 This website is only for the delivery of products to customers in Bangladesh addresses. All goods must be signed for by an adult aged 18 years or over on delivery.
3.2 Delivery charges and estimated timescales are specified in the Home delivery information section when you place an order. We make every effort to deliver goods within the estimated timescales; however, delays are occasionally inevitable due to unforeseen factors. whiteshell.com.bd shall be under no liability for any delay or failure to deliver the products within estimated timescales.
3.3 Risk of loss and damage of products passes to you when the products are delivered or on the date of first attempted delivery by us.

In the case of home delivery, the buyer will not get a chance to try the product. If possible, include a video of the product unboxing. If you receive any defective product, please inform us immediately.

4.1 We take payment from your card or another way when we receive your order after checking your card or other payment details and stock availability. Goods are subject to availability. If we cannot supply the goods, we will inform you of this as soon as possible. A full refund will be given when you have already paid for the goods. In performing these checks, personal information you provide may be disclosed to a registered Credit Reference Agency, which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act.
4.3 The price you pay is the price displayed on this website at the time we receive your order, apart from the following two exceptions:
a) For products reserved online for store pick up or any other reservation service, you pay the price in-store on the collection day.
b) While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. We will treat the order as cancelled if we cannot contact you. You will receive a full refund if you cancel and have already paid for the goods.

4.5 Title to any products you order on this website shall pass to you on delivery of the products provided we have processed and received payment in full.

এই শর্তাবলীর অধীন কোনো বিষয়ের বিধানের কারণে বা তার সাথে সম্পর্কযুক্ত সেই পক্ষের দ্বারা ভুক্তভোগী বা ব্যয়িত।
7.5 উপরোক্ত সত্ত্বেও, ধারা 7.1 এর সাপেক্ষে whiteshell.com.bd’ ক্ষতি বা ক্ষতির জন্য সামগ্রিক দায়বদ্ধতা (চুক্তিতে, টর্ট বা অন্যথায়) যে কোনও ক্ষেত্রে পণ্যের জন্য আপনার দ্বারা প্রদত্ত বা প্রদেয় পরিমাণের সমান পরিমাণে সীমাবদ্ধ থাকবে( s) একই ধারার জন্য দায়ী একটি ঘটনা বা ধারাবাহিক ঘটনার ক্ষেত্রে।

8.6 whiteshell.com.bd এই শর্তাদি এবং শর্তাবলীর অধীনে বা কোনও তৃতীয় পক্ষের সাথে সম্পর্কিত কোনও চুক্তির অধীনে এর যে কোনও অধিকার বা বাধ্যবাধকতার সম্পূর্ণ বা অংশের সুবিধা হস্তান্তর, বরাদ্দ, নতুন বা উপ-কন্ট্রাক্ট করার অধিকার সংরক্ষণ করে।
8.7 যদি এই শর্তাবলীর কোনো অংশ কোনো উপযুক্ত কর্তৃপক্ষের দ্বারা সম্পূর্ণ বা আংশিকভাবে অবৈধ বা অপ্রয়োগযোগ্য বলে ধরে থাকে, তাহলে এই শর্তাবলীর অন্যান্য ধারার বৈধতা বা প্রয়োগযোগ্যতা প্রভাবিত হবে না।
8.8 এই শর্তাবলী কোন পক্ষ নয় এমন কোন ব্যক্তির দ্বারা প্রয়োগযোগ্য কোন অধিকার বা সুবিধা তৈরি বা প্রদান করে না (বিডি চুক্তি (তৃতীয় পক্ষের অধিকার) আইনের অর্থের মধ্যে) ছাড়া:
ক) whiteshell.com.bd (নিচে সংজ্ঞায়িত করা হয়েছে) এই শর্তাবলীর অধীনে কোন অধিকার বা সুবিধা বলবৎ করার অধিকার থাকবে;
খ) whiteshell.com.bd-এর এই শর্তাবলীতে কোনো সীমাবদ্ধতা বা বর্জন বা দায়বদ্ধতার সীমাবদ্ধতার অধিকার বা সুবিধাগুলি কার্যকর করার এবং নেওয়ার অধিকার থাকবে;
গ) একজন ব্যক্তি যিনি এই শর্তাবলীর অধিকার বা সুবিধাগুলির উপরোক্ত ধারা 8.8 এর অধীনে অনুমোদিত উত্তরাধিকারী বা দায়িত্বপ্রাপ্ত ব্যক্তি এই ধরনের অধিকার বা সুবিধাগুলি প্রয়োগ করতে পারেন৷
ঘ) ধারা 8.9-এ উল্লেখ করা ব্যক্তিদের কাছ থেকে কোনও সম্মতির প্রয়োজন নেই যাতে পক্ষগুলি এই শর্তাদি পরিবর্তিত হয় বা প্রত্যাহার করে (যে কোনও উপায়ে এই জাতীয় তৃতীয় পক্ষের পক্ষে অধিকার বা সুবিধাগুলি পরিবর্তিত হয় বা নিঃশেষ করে)।
8.9 এই শর্তাবলীর অধীনে কোন ক্ষমতা, অধিকার বা প্রতিকার ব্যবহার করতে whiteshell.com.bd দ্বারা কোন বিলম্ব বা ব্যর্থতা তাদের মওকুফ হিসাবে কাজ করবে না এবং এই ধরনের কোন ক্ষমতা, অধিকার বা প্রতিকারের কোন একক বা আংশিক প্রয়োগ অন্য কোন বা পরবর্তী অনুশীলনকে বাধা দেবে না তাদের মধ্যে. কার্যকর হতে যেকোন দাবিত্যাগ অবশ্যই লিখিত এবং whiteshell.com.bd-এর একজন অনুমোদিত প্রতিনিধি দ্বারা স্বাক্ষরিত হতে হবে।

10. শারীরিক ক্ষতি নীতি
হোয়াইটশেল থেকে অর্জিত যে কোনও আইটেমের শারীরিক ক্ষতি সফলভাবে গ্যারান্টি সুযোগ বাতিল করবে। অসম্মানজনক স্থাপনা, শারীরিক ক্ষতি, বার্ন কেস, বহিষ্কৃত বা টেম্পারড স্টিকার, তরল দ্বারা সৃষ্ট ক্ষতি বা কোনো আইটেম অপব্যবহার গ্যারান্টি বাতিল হবে। ফলস্বরূপ, হোয়াইটশেল কোনও শারীরিকভাবে ক্ষতিগ্রস্থ আইটেম গ্রাহকের খরচে ক্লায়েন্টকে ফেরত দেবে।
11. ওয়্যারেন্টি: সমস্ত পণ্য শুধুমাত্র প্রস্তুতকারকের ওয়ারেন্টি সহ বিক্রি করা হয়

এক বা অন্য হোয়াইটশেল বা এর সহকারী, অংশীদার বা তাদের কোনো পৃথক প্রতিনিধি, বিশেষজ্ঞ, নির্বাহী, প্রতিনিধি, এজেন্ট, শেয়ারহোল্ডার, অগ্রদূত, উত্তরাধিকারী, বা বরাদ্দকারী (সম্মিলিতভাবে, ‘অধিভুক্ত’) কোনো সার্কিটস, দুর্ঘটনাজনিত জন্য বাধ্য হবে না, অস্বাভাবিক, সংশোধনমূলক, বা উল্লেখযোগ্য ক্ষতিগুলি বিশেষভাবে বা অবস্থানের ব্যবহার থেকে অন্তর্নিহিত দ্বারা উদ্ভূত হয়, অবস্থানে থাকা বা স্থানান্তরিত ডেটা বা অবস্থানের মাধ্যমে অ্যাক্সেসযোগ্য বা প্রাপ্ত আইটেমগুলি, বা অবস্থানে পরিচালিত বিনিময়, প্রকৃতপক্ষে হোয়াইটশেলের ক্ষেত্রে এই ধরনের ক্ষতি বা দুর্ভাগ্যের প্রশংসিততা সম্পর্কে অনুরোধ করা হয়েছে।
কোন উপলক্ষ্যে এই অবস্থান থেকে বিশেষভাবে বা আবর্তিত উপায়ে হোয়াইটশেল বা এর সদস্যদের আবির্ভূত হওয়ার সামগ্রিক ঝুঁকি বা অবস্থানের মাধ্যমে অ্যাক্সেসযোগ্য বা প্রাপ্ত যে কোনও আইটেম সমস্যাযুক্ত একক আইটেমের জন্য আপনার দ্বারা হোয়াইটশেলকে প্রদত্ত অর্থের কম পরিমাণকে অতিক্রম করতে পারে না। তাই আপনি স্বীকার করেছেন যে এই এলাকার সমস্ত ব্যবস্থা অবস্থানের সমস্ত ব্যবহার, অবস্থানে থাকা ডেটা, এবং অবস্থানের মাধ্যমে অ্যাক্সেসযোগ্য বা অর্জিত আইটেমগুলি এবং অবস্থানে পরিচালিত বিনিময়ের জন্য প্রযোজ্য হবে।
